These Terms of Service govern your access to and use of soussandstone.com and your purchase of products from Souss & Stone.

Souss & Stone is a brand owned and operated by SEVOYA LLC, a Massachusetts limited liability company. In these Terms, “Souss & Stone,” “SEVOYA LLC,” “we,” “us,” and “our” refer to SEVOYA LLC.

By accessing the website, creating an account, submitting an order, or otherwise using our services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree, do not use the website or submit an order.

Eligibility

You must be at least 18 years old or the age of legal majority where you live to place an order independently.

A minor may use the website only with the involvement and permission of a parent or legal guardian. The adult submitting an order is responsible for the order and for ensuring products are used appropriately.

You may not use the website where doing so would violate applicable law.

Our Online Store

Shopify provides the e-commerce platform that allows us to operate the website and sell our products.

Products purchased through soussandstone.com are sold by SEVOYA LLC, not by Shopify, unless a checkout page expressly states otherwise.

We may update, suspend, restrict, or discontinue part of the website, product selection, feature, or service when reasonably necessary. We are not required to continue offering a particular product or feature indefinitely.

Product Information

We make reasonable efforts to present product descriptions, ingredients, sizes, photographs, colors, prices, availability, and other information accurately.

Botanical products may have minor variations in:

  • Color;
  • Natural aroma;
  • Clarity;
  • Texture; and
  • Appearance.

Screen settings and photography may also affect how colors or packaging appear.

We may correct typographical errors, inaccuracies, or omissions and update information when necessary. If a material error affects an order already submitted, we may contact you for instructions or cancel and refund the affected item.

Product packaging, ingredients, and presentation may change. Review the current product label, ingredient list, warnings, and directions supplied with the product before use.

Cosmetic Use and Safety

Souss & Stone products are cosmetic and personal-care products unless a product is expressly identified and lawfully marketed otherwise.

Website content is provided for general product and cosmetic-use information. It is not medical advice and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

Use products only as directed. Review the complete ingredient list before use. When appropriate for the product, conduct a small patch test before broader application.

Discontinue use if irritation or an unexpected reaction occurs. Seek advice from an appropriate healthcare professional when a reaction is significant, persistent, or concerning.

Do not use a product if:

  • Its seal is compromised;
  • Its container is broken;
  • It appears contaminated; or
  • Its condition creates a reasonable safety concern.

Individual experiences and cosmetic results vary. Customer reviews, testimonials, traditional-use information, routines, and educational content do not guarantee a particular result.

Orders and Acceptance

Submitting an order constitutes an offer to purchase the products identified in the order.

An automated order-confirmation message acknowledges that we received the order but does not necessarily mean it has been finally accepted.

Before accepting or fulfilling an order, we may verify:

  • Payment;
  • Billing and shipping information;
  • Product availability;
  • Quantity;
  • Promotional eligibility; and
  • Potential fraud or unauthorized activity.

We may decline, limit, hold, or cancel an order when reasonably necessary, including when:

  • A product is unavailable;
  • A price, promotion, or description contains a material error;
  • Payment cannot be authorized or verified;
  • Billing or shipping information appears materially inconsistent;
  • Fraud, unauthorized activity, abuse, or resale is reasonably suspected;
  • An order exceeds reasonable household quantities;
  • Shipping is unavailable to the submitted address; or
  • Fulfilling the order may violate law or create an unreasonable safety or business risk.

If we cancel an order that has already been charged, we will refund the applicable amount to the original payment method.

Products are offered for personal and household use unless we enter into a separate written wholesale or resale agreement.

Prices, Payments, and Taxes

Prices are displayed in U.S. dollars unless stated otherwise.

Prices and promotions may change without advance notice. Changes will not ordinarily affect an order already accepted, except when correcting a material error.

Applicable shipping charges, discounts, and taxes will be displayed during checkout before the order is submitted.

You represent that:

  • Payment information you provide is accurate;
  • You are authorized to use the selected payment method; and
  • The transaction is lawful.

Payment providers may place authorization holds or conduct fraud checks under their own terms.

Shipping, Cancellations, Returns, and Refunds

Order processing, delivery, tracking, address changes, delivery concerns, and ordinary cancellation requests are governed by our Shipping Policy.

Returns, opened-product restrictions, exchanges, damaged or defective products, and refunds are governed by our Return & Refund Policy.

A request to cancel or modify an ordinary one-time order must be submitted within four hours after purchase or before fulfillment begins, whichever occurs first. Requests are not guaranteed after processing or fulfillment begins.

These policies do not limit rights or remedies that cannot legally be waived.

Purchase Options and Recurring Charges

Souss & Stone offers optional recurring subscriptions for eligible products and ritual sets. Available billing and delivery frequencies are displayed before enrollment.

Subscriptions renew automatically at the frequency selected during enrollment until canceled. There is no required minimum subscription term and no minimum number of renewal orders. The initial subscription order is the only minimum purchase commitment.

Before enrollment, we will disclose the material subscription terms, including:

  • The subscribed product or ritual;
  • The recurring price and any applicable subscription discount;
  • The selected billing and delivery frequency;
  • Applicable shipping charges and taxes;
  • That the subscription renews automatically until canceled; and
  • How the subscription may be managed or canceled.

By completing a subscription purchase, you expressly authorize SEVOYA LLC and its payment providers to charge the payment method associated with your subscription for the initial order and each recurring order until cancellation.

You may cancel at any time without a cancellation fee through your customer account or by emailing care@soussandstone.com. Cancellation prevents future renewals but does not automatically cancel or refund an order that was already charged before the cancellation became effective.

Subscription management, renewal charges, cancellation timing, skipped or paused orders, payment failures, and related matters are governed by our Purchase Options Cancellation Policy.

Promotions, Rewards, Referrals, and Discount Codes

Promotions, rewards, referral offers, gifts with purchase, and discount codes may be subject to additional terms displayed with the offer.

Unless expressly stated otherwise:

  • Offers are available for a limited period;
  • Offers may not be combined;
  • Discounts have no cash value;
  • Discounts cannot be applied retroactively;
  • Eligibility may be limited by customer, household, email address, shipping address, product, or order;
  • Free gifts have no refundable cash value when no separate price was paid;
  • Fraudulent, duplicate, automated, self-referral, resale, or abusive participation is prohibited; and
  • We may correct, suspend, or cancel an offer affected by error, fraud, abuse, or circumstances outside our reasonable control.

A deduction involving an unreturned threshold-based promotional gift will be made only as explained in our Return & Refund Policy and when the condition and promotional value were disclosed before purchase.

Gift Cards and Store Credit

Gift cards and store credit may be subject to separate terms displayed when they are issued or purchased.

They may not be redeemed for cash except where required by law.

Lost or stolen gift cards or store-credit codes may not be replaceable unless ownership and the remaining balance can be reasonably verified.

Customer Accounts

You are responsible for:

  • Providing accurate account information;
  • Protecting your login credentials; and
  • Promptly notifying us of suspected unauthorized access.

We may temporarily suspend or restrict an account to protect the customer, website, or business.

To the extent permitted by law, we may restrict or close accounts associated with fraud, abuse, prohibited conduct, repeated unsupported claims, or material violations of these Terms. This does not eliminate non-waivable rights concerning completed purchases.

Reviews and User Content

When you submit a review, photograph, comment, testimonial, suggestion, or other content, you represent that:

  • You own or have permission to submit it;
  • It is truthful and based on your genuine experience where presented as a review;
  • It does not infringe another person’s rights;
  • It does not contain confidential information;
  • It is not unlawful, deceptive, defamatory, threatening, obscene, or malicious; and
  • It does not contain malware or harmful code.

You retain ownership of your content.

By submitting content to us, you grant SEVOYA LLC a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, publish, display, distribute, and use that content in connection with our website, products, customer service, and marketing.

We may make reasonable formatting or length edits but will not knowingly change the material meaning of a customer review.

We are not required to publish user content and may remove or decline content that:

  • Violates these Terms;
  • Contains private information;
  • Is unrelated to the product;
  • Appears fraudulent or misleading; or
  • Creates a legal, safety, or security concern.

We will not condition an incentive on a positive review. A material connection or incentive relating to a review should be clearly disclosed.

Intellectual Property

The website and its contents—including text, graphics, photographs, product presentation, logos, icons, page design, video, audio, and software—are owned by or licensed to SEVOYA LLC and protected by applicable intellectual-property laws.

“Souss & Stone,” associated logos, product names, packaging elements, and brand features may be protected by trademark, trade-dress, copyright, and unfair-competition laws.

You may access the website for personal, noncommercial shopping and informational use.

You may not, without written permission:

  • Copy or reproduce protected content;
  • Republish or distribute it;
  • Sell or commercially exploit it;
  • Modify it or create derivative works;
  • Frame the website;
  • Scrape or harvest website data; or
  • Use brand materials in a way that suggests unauthorized affiliation.

Nothing in these Terms limits uses permitted by applicable law.

Prohibited Uses

You may not use the website or services to:

  • Violate applicable law;
  • Commit fraud;
  • Submit unauthorized payment information;
  • Interfere with website security or operation;
  • Introduce malware or harmful code;
  • Conduct automated attacks;
  • Scrape or collect data without authorization;
  • Impersonate another person;
  • Misrepresent your identity;
  • Submit false reviews, claims, chargebacks, or return materials;
  • Circumvent quantity limits or promotional rules;
  • Purchase products for unauthorized resale;
  • Infringe intellectual-property, privacy, or publicity rights; or
  • Harass, threaten, or abuse customers, staff, service providers, or others.

We may take reasonable steps to prevent, investigate, or address prohibited conduct.

Third-Party Tools, Links, and Services

The website may provide access to third-party:

  • Tools;
  • Applications;
  • Payment services;
  • Social-media platforms; and
  • Websites.

We do not control every third-party service and are not responsible for its independent content, availability, security, or privacy practices.

Use of a third-party service may be governed by that party’s own terms and privacy policy. The presence of a link does not necessarily constitute endorsement.

Website Availability

We aim to keep the website available and accurate, but uninterrupted or error-free access cannot be guaranteed.

Maintenance, updates, internet failures, platform disruptions, security events, carrier outages, or circumstances outside our reasonable control may temporarily affect access.

Disclaimer of Warranties

To the maximum extent permitted by law, the website and general website content are provided on an “as available” basis without warranties concerning uninterrupted access, error-free operation, or suitability for every individual purpose.

Products remain subject to:

  • Their descriptions;
  • Our express commitments;
  • Applicable express warranties;
  • Applicable implied warranties; and
  • Rights and remedies that cannot legally be excluded.

Nothing in these Terms excludes a remedy for a product that is defective, contaminated, unsafe, materially misdescribed, or incorrectly supplied.

Limitation of Liability

To the maximum extent permitted by law, SEVOYA LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the website or a transaction when those damages may lawfully be limited.

For a claim involving ordinary economic loss, our aggregate liability will not exceed the amount paid for the product or order giving rise to the claim, to the extent such a limitation is permitted by law.

These limitations do not apply to:

  • Fraud;
  • Willful misconduct;
  • Gross negligence;
  • Personal injury caused by negligence where liability cannot lawfully be limited;
  • A legally required product remedy; or
  • Another liability that applicable law does not permit us to exclude or limit.

Some jurisdictions do not permit certain warranty disclaimers or liability limitations. Portions of this section may therefore not apply to every customer.

Indemnification

To the extent permitted by law, you agree to reimburse SEVOYA LLC for reasonable losses, liabilities, and expenses arising directly from:

  • Your unlawful misuse of the website;
  • Your material violation of these Terms;
  • Your infringement of another person’s rights; or
  • Content you submit in violation of these Terms.

This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, defective products, or obligations that cannot legally be transferred.

Privacy

Our collection and use of personal information are described in our Privacy Policy.

Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal law, without regard to conflict-of-law rules.

A court proceeding that may lawfully be required to occur in Massachusetts will be brought in an appropriate state or federal court serving Worcester County, Massachusetts.

This section does not deprive a consumer of:

  • Mandatory legal protections; or
  • The right to bring a claim elsewhere when applicable law does not permit that right to be waived.

Before filing a claim, we encourage you to contact care@soussandstone.com so the matter can be reviewed. Contacting us is not a waiver of any legal right or filing deadline.

Changes to These Terms

We may update these Terms to reflect changes in:

  • Law;
  • Services;
  • Products;
  • Technology; or
  • Business practices.

The revised effective date will appear at the top.

Changes generally apply prospectively. The Terms applicable to an order will ordinarily be those presented when the order was submitted, except when a change is required by law or gives the customer greater protection.

Severability and Waiver

If a provision is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

A failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment

You may not assign your rights or obligations under these Terms without our written consent.

We may assign these Terms in connection with a merger, financing, reorganization, sale of assets, or transfer of the business, subject to applicable law.

Entire Agreement

These Terms and the policies incorporated into them form the agreement between you and SEVOYA LLC concerning the website and purchases made through it.

Additional terms expressly presented for a promotion, rewards program, referral offer, gift card, or future purchase option also apply to that feature.
